Finally, we’ll look at how both EU Directives will develop in practice.

Both these directives have now been politically agreed, it will probably take until 2026 to work their way through into national legislation and to become an effectively “biting” regulation.

When we look at what the best companies are already doing, they are already leading in terms of Net Zero Commitments. Mosty already put emission reductions before offsets, and this is exactly aligned with upcoming regulations already. So that is probably all good news.

However, there is one challenge, and a related opportunity:

The challenge: most “carbon neutral” claims currently use nature-based credits to offset residual emissions. Under the new EU regulations, marketing this as “carbon neutral” would no longer be allowed. These companies would have to buy “permanent removal credits” (as defined above), if they want to continue to make such a carbon neutral claim.  

The opportunity: Those “permanent removal credits” require two things: biogenic or sustainable CO2 which is then transported to and injected into permanent, subsurface geological storage (monitored by the respective national regulator). Carbon Capture Scotland are offering credits based on this process for delivery from 2026 onwards. These can be contracted immediately, meaning that forward-looking companies can secure volumes and pricing today.
